What Is the Difference Between Contested and Uncontested Divorce?
An uncontested divorce occurs when both parties agree with the terms of their divorce. This may include the separation of their property, assets, child custody, alimony, and even the end of the marriage. While a contested divorce indicates that the couple disagree regarding various matters pertaining to the divorce. When contested, a court will need to make the final decision.
What Does Dissolution of Marriage Mean in Arizona?
In Arizona, divorce is legally referred to as the “dissolution of marriage”. It is the legal proceedings taken to end a marriage.
Is Arizona a No-Fault Divorce State?
Yes! This means that the spouses do not need to provide any assertions or proof of fault to be able to effectively end the marriage. Either spouse can dissolve a marriage on the grounds that it is “irretrievably broken.”
What Is a Covenant Marriage?
Arizona is only one of three states to legally recognize a covenant marriage (ARS § 25-901), where the couple must attend pre-marital counseling and the grounds for a divorce are more restrictive.
Some of the Grounds for Divorce in a Covenant Marriage Under ARS § 25-903 Include:
- Adultery
- One spouse leaving the marital property (abandonment)
- Conviction of a felony with the penalty of death or imprisonment
- Abuse or Domestic Violence
- Living separately for a minimum of 2 years
- Drug or Alcohol Abuse
