Spousal Support and the Law
Resolving the spousal support question is a two-step process. The Court first determines if the spouse requesting spousal support is able to support herself or himself, and then decides what the support level should be. Unlike child support, with spousal support there are no firm guidelines in the law that define how much support should be provided. However, Arizona law discusses a number of potential factors to be considered when determining whether spousal maintenance is appropriate. These factors include whether the spouse seeking spousal support is able to be self-sufficient, whether they contributed to the other spouse's educational opportunities, or whether the spouse seeking support has sufficient property to provide for their needs.
