What Is an Emergency Divorce Order?
An emergency order is one where you can usually appear before a judge that day (or the following day) and seek an order to grant a particular form of relief such as a change in child custody or a restraining order. You can appear before the judge without providing notice to the other party or having the other party present in court. The court can grant your order based on your testimony alone and serve the order on the other party.
After granting the emergency order, the court will set a hearing date so the other side can appear in court and present his or her side of the issue. At that time, the order can be modified, made permanent or dismissed.
When Can I Obtain an Emergency Divorce Order?
To obtain an emergency order in Arizona, you must show the judge that you or your child may suffer irreparable damage if the court does not enter the order immediately. Examples of times when you may seek an emergency order include:
- An ex-spouse is arrested driving under the influence of drugs or alcohol with the children in the car.
- An ex-spouse has an addiction to meth or other drugs, endangering the children.
- You are a victim of domestic violence and you need a protection order.
- Your children are exposed to domestic violence or are victims themselves.
- The health and safety of your children or yourself is at risk.
- A spouse is depleting community assets while your divorce is in process.
